The Federal Energy Regulatory Commission adequately explained why it granted a certificate for Enbridge Inc.’s 256-mile Nexus Gas Transmission project, and its approval was lawful, even though the project will be used to export natural gas to Canada, the D.C. Circuit said Friday.
Nexus is “indisputably using its proposed pipeline to transport gas in interstate commerce,” according to the US Court of Appeals for the District of Columbia Circuit. Therefore, it’s a natural gas company and FERC could study its application under Section 7 of the Natural Gas Act, the court said.
